Rules of engagement (aka Terms and Conditions)

By signing up to any of the programs advertised on the SMART Fitness Makeover™ website (whether Home Study, Virtual Academy or VIP Experience), you are acknowledging that you have read, agree to and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time by sending you a revised version to your email address on our records.

You are responsible for the full payment of our fees relating to the Program you wish to purchase or subscribe to, regardless of whether you actually attend the live training (when provided as part of the Program) or complete the Home Study assignments, and regardless of whether you have selected to pay in full upfront or have agreed to a payment plan. To further clarify, all monthly payments must be paid on a timely basis. It is your responsibility to ensure you have the means to pay for the Program that you are purchasing and that this is not placing you or your family under undue financial strain.

We are committed to providing all our Customers with a positive and uplifting learning experience and we will endeavour to carry out the live components of our Programs in a friendly and non-judgmental manner. We expect you to do the same. Should you become disruptive or disrespectful of the SMART Fitness Makeover™ Programs or fellow participants we reserve the right to terminate this agreement and limit, suspend or terminate your participation in our private Facebook Groups, live Virtual Academy or VIP Experience Programs without refund or cancellation of your remaining monthly payments.

We respect your privacy, your confidential and proprietary information ideas, plans and trade secrets and we must insist that in return you respect the privacy, confidential and proprietary information ideas, plans and trade secrets of the SMART Fitness Makeover™ and your fellow Program participants (Home Study and Virtual Academy).

By purchasing one of our Programs, you agree:

(1) not to infringe any copyright, patent, trademark, trade secret or other intellectual property rights of the SMART Fitness Makeover and/or fellow Program participants;

(2) that any Confidential Information shared by the SMART Fitness Makeover™ and/or fellow Program(s) participants belongs solely and exclusively to the individual that discloses it and must not be shared with anyone outside of the Program(s) you are participating in (this includes external forums and social media);

(3) all materials and information provided to you by the SMART Fitness Makeover™ are confidential and our proprietary intellectual property, being solely and exclusive to the SMART Fitness Makeover™;

(4) the reproduction, distribution and sale of these materials by anyone but the SMART Fitness Makeover™ is strictly prohibited.

We have made every effort to accurately represent the potential for weight/fat loss and reshaping of our Home Study, Virtual Academy and VIP Experience Programs. However, we cannot guarantee that you will achieve the full potential of the results that are possible when following our System. Your success depends on many factors, including your background, your body’s inherent responsiveness to diet and exercise, your dedication to the Program of your choice, the strength of your desire to implement changes, your willingness to see the Program through to its end and your motivation to succeed.

By purchasing our Programs, you acknowledge that as with any other self improvement investment, there is an inherent risk of loss of capital and there is no guarantee that you will achieve your weight/fat loss and reshaping goals as a result of your participation in either one of our Home Study, Virtual Academy and VIP Experience Programs. Moreover there is no way that we can verify your conduct outside of your active participation to a Program (whether via Facebook Group or private coaching area) and we have to trust that you are being truthful at all times when discussing your adherence to the program.

For this reason we do not offer any refunds on any of our Programs nor we will issue any partial refunds if you miss any of the live sessions being part of a Virtual Academy term or VIP Experience (we will however endeavour to record these and make the recordings available to you as soon as possible after the event). We will notify you of the dates and times of your Virtual Academy live sessions with at least 3 days notice and it is your responsibility to show up for the call on time.

When taking part in the VIP Experience Program, at the end of each call, we will book our next live session for a mutually convenient time and if you need to cancel or postpone any of the calls we ask that you give us at least 24hrs notice. Failure to do so will result in you losing that session and being unable to claim a refund for it.
